Through legislation, testing, and research, Maine has effectively \u201cturned off the tap\u201d of these contaminants on farmland. In 2022, Maine State Legislature passed laws making new sludge application illegal, but the practice of biosolid sludge spreading is still allowed nationally. Meaningful change will require federal action. On May 14, 2024, we gave the U.S. EPA notice that we\u2019re going to sue them for failure to regulate PFAS in sludge under the Clean Water Act. <a href=\"https:\/\/www.mofga.org\\\/wp-content\/uploads\/2024\/05\/MOFGA-NOI-EPA-PFAS-Sludge-05142024.pdf\" target=\"_blank\" rel=\"noopener\"><b>Read the notice of intent here<\/b><b>.<\/b><\/a> Join us by <strong><a href=\"https:\/\/actionnetwork.org\/letters\/epa-take-action-on-pfas\" target=\"_blank\" rel=\"noopener\">sending a letter to the EPA urging them to ban sludge<\/a><\/strong>!<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Maine Department of Agriculture, Conservation and Forestry (DACF) and the Department of Environmental Protection (DEP) have been testing water supplies and farmland where biosolid sludge has been applied, and by 2025, all sites that were permitted for sludge application will be tested, using a tiered prioritization system. <\/span><span style=\"font-weight: 400;\">Testing is intended to identify communities where land or groundwater is contaminated. <\/span><span style=\"font-weight: 400;\">MOFGA\u2019s policy team is working at the state and national levels to further limit PFAS in our food system and create a federal safety net for farmers through the \u201c<\/span><a href=\"https:\/\/actionnetwork.org\/letters\/urge-your-members-of-congress-to-support-the-relief-for-farmers-hit-with-pfas-act\/\" target=\"_blank\" rel=\"noopener\"><b>Relief for Farmers Hit with PFAS Act<\/b><\/a><span style=\"font-weight: 400;\">.\u201d&nbsp;<\/span><\/p>\n<p><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-21a3253 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"21a3253\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-9c5e872\" data-id=\"9c5e872\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-1be7cc7 elementor-widget elementor-widget-heading\" data-id=\"1be7cc7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What Are PFAS? Known as \u201cforever chemicals,\u201d PFAS linger in the environment indefinitely and are in the air, water, and soil, and in our bodies. They are damaging to human health at even the lowest levels. Over the past few years, PFAS have emerged as a growing contaminant of concern for the food supply in Maine and elsewhere. Biosolid sludge applications are not permitted in organic production, but these substances do not decompose and remain in the environment for decades after initial application. Through no fault of their own, farmers are having to close farms or shift production to respond to PFAS contamination.
